AmeriBookkeeper respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), Title 17, United States Code, Section 512(c), AmeriBookkeeper has adopted the following policy toward copyright infringement on its web service, accessible via ameribookkeeper.com. This page outlines the process for submitting a DMCA notice to AmeriBookkeeper and what to expect in response to such a notice.

Submitting a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through the AmeriBookkeeper service, please notify our copyright agent as described below. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the owner of the copyright interest;
  2. A description of the copyrighted work that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the site (preferably including specific URLs);
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Response to DMCA Notice

Upon receipt of a valid DMCA notice, AmeriBookkeeper will act to remove or disable access to the material claimed to be infringing. Furthermore, AmeriBookkeeper may notify the content provider, member, or user that we have removed or disabled access to the material. Repeat infringers will have all material removed from the system and AmeriBookkeeper may terminate such content provider’s, member’s, or user’s access to the service.

Counter-Notice

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to our copyright agent:

  1. Your physical or electronic signature;
  2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content; and
  4. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction], and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by AmeriBookkeeper, we may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed content or cease disabling it in 10 business days. Unless our copyright agent receives notice from the original complaining party that an action has been filed seeking a court order to restrain the content provider, member, or user from engaging in infringing activity relating to the content on AmeriBookkeeper’s system or network, we may replace the removed content or cease disabling access to it.
